The Personal Prosecution Mock Trial aims to educate in the circumstances that could lead to personal regulatory enforcement action against individuals who are responsible for implementing health and safety within their organisation.
It concerns the personal prosecution of two Company Directors following a workplace accident. The trial involves specialist practicing barristers, with the case being heard by a Crown Court Recorder to ensure that it is as realistic as possible. It offers a unique opportunity to gain first-hand experience of watching a criminal trial in a courtroom setting.
You will have the chance to observe witnesses providing evidence under cross-examination and engage in the trial by carefully considering the evidence. At the conclusion of the case, you will be invited to act as a jury member and reach a verdict based on the evidence heard during the trial.
Attendees will gain experience and knowledge in the following areas:
- An understanding of the importance of documentary evidence and how it can influence a Court or Jury.
- An understanding of the importance of capturing evidence and undertaking detailed accident investigations.
- An insight into the pressures a witness experiences whilst giving evidence under cross examination.
- Understanding individual responsibility for health and safety and the potential consequences of a personal injury claim or regulatory prosecution.
- Improving defensibility whilst avoiding a regulatory investigation or prosecution.
- Reducing the cost of claims and regulatory fines which will have a financial impact on your organisation and the cost or availability of insurance.
The Mock Trial has been designed for individuals who have responsibility for funding and implementing health and safety within their organisation. This includes directors, senior leaders, operational managers, health and safety professionals, insurance teams, human resources, finance, in-house legal departments, among other relevant roles.
